Trial Over Raid on Tribal Smoke Shop Begins Friday

The trial of seven Narragansett Indians arrested for scuffling with police who raided a tribal smoke shop will begin Friday, potentially reopening a painful period between Rhode Island and its only federally recognized American Indian tribe.

Lawyers selected sixteen jurors on Thursday who must decide whether Chief Sachem Matthew Thomas, the tribe's leader, and six other defendants are guilty of misdemeanor crimes ranging from disorderly conduct to assault. Each charge carries a maximum one-year prison sentence, although lawyers think it is unlikely any of the defendants would face jail time if convicted.

The arrests happened on July 14, 2003, when state police raided a tribal smoke shop in Charlestown that was not collecting state taxes. Jurors were bused to that now-vacant shop Thursday afternoon so they could view the area before testimony begins.

Whether commissioners buy into Stoffa's plan may hinge on whether they consider the facility a prison, or what Stoffa calls it: a treatment facility. It would be in a general industrial zone, which allows treatment centers. However, a prison would require a zoning change.

The project would need approval from the township commissioners and County Council, where Stoffa also may face opposition.

''I think we should be expanding on our existing [prison] campus in Easton,'' said county Councilman Charles Dertinger of Washington Township. ''What happened to that plan? Why are we going off campus?''

Actually, going off campus is the point, Stoffa said. The inmates would have a better chance of avoiding a repeat offense if they're not mixed in with a general prison population that includes inmates charged with rape, homicide and assault, he said.
