Councilwoman's change of venue request denied

Clearly were disappointed, Kelleys attorney, Lisa Gygax of Forestville, said after the brief hearing.

However, Gygax noted that the judge expressed a willingness to reconsider the issue if new facts come forth. The attorney said if jurors are aware of the press coverage, she is prepared to renew the motion.

Prosecutors had opposed Kelleys motion. Deputy District Attorney Tom Gotshall said in court Thursday that Sonoma Countys population of nearly 500,000 residents would provide an adequate pool of impartial jurors.

The judge set a trial date of March 25. If convicted on the vandalism charge, Kelley could be sentenced to a year in jail and fined $10,000.

Kelley also faces misdemeanor drunken-driving charges stemming from an arrest in May in Guerneville.


Palestinian suicide bomber attacks shopping centre

A Palestinian suicide bomber has attacked a shopping centre in a remote southern Israeli town, killing one woman and wounding nine other people.

Militants claimed the attacker infiltrated Israel from Egypt, fuelling Israel's concerns that it was left more vulnerable to assault after Gaza militants blew up the border with Egypt.

Police said they killed a second attacker before he had a chance to detonate his explosives belt. The severed head of the suicide bomber lay in a pool of blood next to his shot comrade.

An offshoot of moderate Palestinian president Mahmoud Abbas's Fatah movement claimed responsibility for the attack, complicating recently revived peace talks. Militants said other attackers were already inside Israel, poised to carry out further assaults.


Watch for viruses in Valentine's Day e-mails, FBI says

Categorized as malicious software or malware, the e-mail directs the recipient to click on a link that will retrieve the e-card. Once the link is clicked, malware is automatically downloaded to the users computer.

According to the FBI, a botnet is dispersed into the computers internal system. Once this happens, the computer can be controlled by the invading third party.

It affects almost every type of Microsoft operating system, and once the virus infiltrates the computers files, the files can be manipulated or destroyed.

The FBI warns the public not to open e-mails from unknown users or click on unfamiliar links.

The FBI has established a Web site dedicated to alerting the public of any new e-scams at www.fbi.gov/cyberinvest/escams.htm.

Long-running dispute over Chesapeake tract settled

A long and contentious legal battle over one of the largest undeveloped tracts left in Chesapeake has been settled, ending a case that highlighted the difficult balance of property rights and government protection of wetlands.

The U.S. Department of Justice released three proposed agreements last week that would resolve alleged wetlands violations dating to 1999 on the Bosher Tract, also known as the Green Sea Farm, a 1,560-acre parcel in southern Chesapeake.

The Bosher family, which owns the land, says hired hands merely were cleaning out farm ditches in 1999, the government says they were illegally dumping muck and dirt from the ditches into ecologically important nontidal wetlands, considered "waters of the United States."

The settlements side step this core issue, but include a $65,000 penalty against Elwood H.

Nolan's hat trick lifts Flames past Sharks

Owen Nolan recorded his 11th career hat trick as the Calgary Flames held off the San Jose Sharks, 5-4, at Pengrowth Saddledome.

It was Nolan's first three-goal game since October 4, 1999 versus Chicago.

Wayne Primeau and Dion Phaneuf also scored for the Flames, winners of four straight. Alex Tanguay and Craig Conroy each added a pair of assists, while Miikka Kiprusoff stopped 27 shots for Calgary, which had not played since last Tuesday, when it beat Minnesota 2-1.
